Every person other than an owner who uses any field-channel in respect of which any repair has been executed by a Canal Officer under section 31 shall, in the absence of any agreement between the parties or of any condition imposed under section 29, at the time such person was authorised to use such field-channel to the contrary, be liable to pay to the Appropriate Authority such proportion of the expenses incurred in the execution of such repairs as shall be determined by the said Canal Officer.
