Section 5

Term of office.

( 1 ) Save as otherwise provided by this Act, the term of office of the members whether elected or nominated, shall be for a period of five years commencing from the date on which the first meeting of the 1 [Council] is held 2 [under clause ( a ) of sub-section ( 3 ) of section 4]. ( 2 ) The term of office of an outgoing member shall be deemed to extend to and expire with the day immediately before the day of the first meeting referred to in sub-section ( 1 ) ( 3 ) An outgoing member shall be eligible for re-election or re-nomination. 3 [( 4 ) The term of office of the President and Vice-President shall be for a period of one year from the date of their election as President or Vice-President, as the case may be: Provided that, at no time the term of office of the President or Vice-President shall exceed the term of such President or Vice-President, as a member.]
