( 1 ) No prosecution for an offence under this Act shall be instituted except by or with the consent of the District Authority, by general or special order. ( 2 ) No court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the First Class shall try any offence under this Act. ( 3 ) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), offences punishable under this Act and rules made thereunder shall be cognizable.
