Proof of sanction.-The sanction for prosecution of a govermnent servant for an offiellce unde this Act, issued under section 197 of the Code of Criminal Procedure- 1973 (No.2 of 1974), and purporting to be duly authenticated and sealed, shaH be admi- ssible in evidence without formal proof : . Provided that, where the facts comtituting the offence do:not appear on the face of the .sanction, the Court may call the olicer authenticating the sanction to give evidence before it. 1Substituted for the four provisions to Sec. 39 vide M.
