Licensing markets.-(1) It shall be lawful for the Council to direct that no place other than a Municipal market shall be used for the sale of animals, meat, fish, fruits, vegetable or such other articles as the Council may, with the prior sanction of the prescribed authority, specify in this behalf except under and in accordance with the conditions of a licence from the Council which may, at its discretion from time to time, grant, suspend, withhold or withdraw such licences either generally or in individual cases. (2) Whoever uses or permits the use of any place contrary to such direction or without the licence required as aforesaid, or in contravention of any of the conditions or during the suspension or after the withdrawal of such licence, shall be punished with fine which may extend to fifty rupees. (3) Upon a conviction being obtained inn respect of any place under sub-section (2), the Magistrate shall, on the application of the Chief Municipal Officer or any officer authorized by him but not otherwise, order such place to be closed, and thereupon appoint persons or take other steps to prevent such place being so used; and every persons or take other steps to prevent such The Madhya Pradesh Municipalities Act, 1961 99 place after it has been so ordered to be closed shall be punished with fine which may extend to five rupees for each day during which he continues so to use, or permits such use of the place after it has been so ordered to be closed.
