Displacing pavements, etc.- (1) Whoever displaces, takes up, or makes any alteration in the pavement, gutter, flags of other materials or any public street or the fences, walls posts, Municipal lamps, lamp posts, brackets, water-posts, hydrants or other Municipal property, therein, without the written consent of the Council or other lawful authority, shall be punished with fine which may extend to one hundred rupees. (2) Any person who, having displaced, taken up or made alteration in any such pavement, gutter, flags or other materials or in such fences, walls, posts, Municipal lamps, lamp posts, brackets, water-posts, hydrants or other Municipal property, shall fail to replace or restore the same to the satisfaction of Council after notice to do so, shall be punished with fine which may extend to fifty rupees and shall pay any expense which may be incurred in replacing or restoring the same; The Madhya Pradesh Municipalities Act, 1961 88 and such expenses shall be recoverable in the same manner as an amount claimed on account of any tax recoverable under Chapter VIII.
