Municipal Officer or servant not to be interested in any contract with Corporation.- (1) No person shall be eligible for employment as a Municipal Officer or servant if he- Madhya Pradesh Municipal Corporation Act, 1956 32 | P a g e (a) has directly or indirectly, by himself or his partner, any share or interest in any contract or employment with, by or on behalf of the Corporation, other than an interest in land held on a lease from the Corporation, or is a Director, Secretary, Managewr or other salaried officer of an incorporated company which has any such share or interest; or (b) has acted or is acting professionally in relation to any matter on behalf of any person having therein any such share or interest as aforesaid. (2) If any Municipal Officer or servant acquires, directly or indirectly by himself or by his partner any share or interest as aforesaid, otherwise than as such officer or servant, he shall cease to be a Municipal Officer or servant, and his office shall become vacant. (3) Nothing in the foregoing sub-sections shall apply to any such share or interest as, under section 35 it is permissible for a Councillor to have without being thereby prohibited from voting or taking part in the discussion of any matter.
