Factories not to be established, etc., without permission of Commissioner.- No person shall- (a) newly established, or (b) remove from one place to another, or (c) re-open or renew after discontinuance for a period not less than three years, or (d) enlarge or extend the area, or dimensions of any factory, workshop or bakery in any area, other than an area set apart for the accommodation of industries by an Act, for the time being in force or by any local authority, except with the permission of the Commissioner and in accordance with the terms and conditions stated in such permission: Provided that no such permission shall be required in the case under clause (c) if during the period of discontinuance the machinery has not been removed from the place where the factory, workshop or bakery was originally established.
