Repair and closing of drains, privies, latrines, urinals, etc.- (1) The Commissioner may by notice, require the owner or occupier of any building or land to repair, alter or put in good order any private drain, privy latrine, urinal, absorption pit, disposal work cesspool or receptacle for any filth or refuse, or to close or destroy any private drain, privy, Madhya Pradesh Municipal Corporation Act, 1956 87 | P a g e latrine, urinal absorption pil, disposal work or cesspool belonging there to, or direct that such private drain shall, from such date as he prescribes in this behalf, be used for offensive matter and sewage only, or for rain-water and unpolluted sub-soil water only, and by written notice require the owner or occupier of the premises to make an entirely distinct private drain for rain water or for unpolluted sub-soil water of for offensive matter and sewage. (2) No drain connecting any premises with a municipal drain or other place set apart for the discharge of drainage may be closed, discontinued or destroyed by the Commissioner under sub- section (1) except on condition of his providing another drain equally effectual for the drainage of the premises and communicating with such municipal drain or other place aforesaid as the Commissioner thinks fit; and the expenses of construction of any drain so provided by the Commissioner and of any work dome under this Section shall be paid from the municipal fund.
