Unauthorized use and waste or water.- (1) Water is said to be used in an "unauthorized" manner when its use gives rise to, or may be expected to give rise to; benefits of any kind and (a) When it is allowed or caused to flow on to land, or into a village tank, or Into a private system of Irrigation, or into any system for the supply of water for an industrial, urban or other purpose not connected with agriculture, so that the owners or occupiers of such land Or system thereby obtain for such land Or system water to which they are not entitled under the Provisions of this Actor of the rules or of any agreement Or contract made there under; or (b) When It is taken from any canal, outlet or water-course in contravention of any of the provisions of this Act or of the rules made the rounder or of any order by a canal officer passed there under. (2) Water which Is allowed or caused to escape from a canal, water course or field In such a manner that no benefits arise from its consumption Is said to be "wasted".
