Eviction of defaulter member and tenants etc. and non-applicability of the Jammu and Kashmir Houses and Shops Rent Control Act, 1966.—(1) Notwithstanding anything contained in Jammu and Kashmir Houses and Shops Rent Control Act, 1966 or in any other law for the time being in force, when the mortgaged property sold in accordance with the provisions of this Act, is occupied by tenant or borrower or any other persons, such person shall be evicted forthwith treating him illegal and unauthorised occupant. (2) Nothing in the aforesaid Act, shall apply to the Houses, flats, buildings owned by the Housing Societies or and all matters regarding fair rent, enhancement of rent and eviction of premises, etc. shall be decided by the Registrar or officer authorised by him who shall be the final authority.
