Agreement or payment not to bar acquisition under fresh declaration.- lfany land in respect of which the payment of a betterment fee has been accepted in pursuance of su b-sect10n (3) of section 81 or has been made after Its determination under section 82 or section 85 or in respect of which an agreement regarding the bette• ment fee has been executed under section 86, be subsequently required lor any of the pur- poses of this Act, the payment or agreement shall not l1e deemed to prevent the acquisition of the land in pursuance of a fresh declaration pu bhshed under section 6 of the Land Acquisition Act (Tmvancore Act XI of 1089).
