Punishment for malicious abuse of powers——(1) Any executive authority of a local authority or any officer or servant of a local authority or of the Government, or any person appointed under Section 10 of this Act, who maliciously abuses any powers conferred on him by or under this Act, shall be punished with imprisonment which may extend to one year or with fine which may extend to one thousand rupees or with both. (2) No prosecution shall be instituted under this section without the previous sanction of the Government 154, Delegation of powers by Government.—The Govern- ment may, by not*fication and subject to any _ restrictions, limitations and cond'tions specified therein, authorise any per- son to exercise any one or more of the powers vested in them by this Act and may in like manner withdraw such authority: Provided that nothing contained in this section shall apply to any power of the Government to make rules under this Act or to their powers under Sections 6(2), 185 and 161.
