(1) No person shall, without lawful authority or excuse, have in his possession any document containing any prejudicial report or any unauthorised cinematograph film of the nature described in sub-section (3) of Section 31. (2) Any person who without lawful authority or excuse, has on any premises in his occupation or under his control any document containing any prejudicial report shall, unless he proves that he did not know and had no reason to suspect that the said document contained any such report as aforesaid or that the said document was on such premises without his knowledge or against his consent, be deemed to have contravened this section. (3) The licensee of any building or other premises licensed under the Cinematograph Act, for the time being in force, in or on which any unauthorised film is found shall, unless he proves that the said unauthorised film was in or on such building or other premises without his knowledge or against his consent, be deemed to have contravened this section. (4) In any proceedings arising out of a contravention of this section in respect of the possession of any document it shall be a defence for the accused to prove that the said document (a) was in his possession with the permission or under the authority of the Government; or (b) was a proof prepared by or for him for submission to the Government or to a person or authority designated by the Government in this behalf with a view to the obtaining of permission for its publication. (5) If any person contravenes any of the provisions of this section, he shall be punishable with imprisonment of either description for a term which may extend to one year or with fine or with both.
