Section 8

Supervening disqualification.--

(1) If a person elected or nominated as a member of the Board is or subsequently becomes subject to any of the disabilities stated [in clauses (i), (ii), (iv), (v) and (vii) of section 7], and is declared by a Court to be under such disability as hereinafter provided, or becomes subject to the disability mentioned [in clause (iii), (vi) or (viii) of section 7] or [ceases to be a Hindu] [or has absented himself from three consecutive meetings of the Board] he shall cease to be a member. [Provided that where the cessation of membership is on the ground of absenting himself from the meetings of the Board, the membership may be restored by the Board, if it is satisfied that there was reasonable and sufficient grounds for not attending such meetings: Provided further that such restoration of membership shall not be allowed for more than once.] (2) Any person interested may apply to the District Court, Trivandrum, for an order that a member of the Board has become subject to any of the disabilities stated in clauses [in clauses (i), (ii),(iii), (iv), (v), (vi), (vii) and (viii) of section 7] and the Court may, after making such enquiry as it deems fit, by order determine whether or not such member is disqualified. (3) An appeal shall lie to the High Court against an order under sub-section (2) and such appeal shall be heard and disposed of by a Division Bench. (4) Until an application has been made under sub-section (2) and final orders are passed thereon, the member who is alleged to be subject to the disabilities stated [in clauses (i), (ii), (iii), (iv), (v), (vi), (vii) and (viii) of section 7], shall be entitled to act as if he were not disqualified.
