Penalty.— (1) Any person who acts in contravention of section 36 shall, on conviction be punishable with fine which may extend to two lakh rupees for the first offence and five lakh rupees for each subsequent offence after his conviction for such first offence. (2) Any qualified person without a valid registration under this Act who practises in the branch of his qualification or other branches and any death or invalidity to a human life causes, he shall be liable on conviction for a penalty of rupees five lakh or imprisonment for a term of one year or both. (3) Any person without qualification or valid registration practises in any system of medicine and his practice causes death or permanent invalidity, on conviction, he shall be liable for a fine of rupees five lakh or imprisonment for a term of two years or both and on subsequent offence double the fine and term of imprisonment and also the offences affecting human body under Chapter XVI of Indian Penal Code, 1860 (Act 45 of 1860) shall, appropriately be applicable, 60 according to the nature of gravity affected human body by such an unlawful activity.
