[(1) Whoever commits any breach of the provisions of Section 5A and 5C of Chapter IA shall be punishable,- (a) with fine which may extend to 5A[five thousand rupees] and in case of continuing breach with fine which may extend to 5B[two hundred and fifty rupees] for every day during which the breach continues after conviction for the first breach; or (b) with fine which may extend to 5B[two hundred and fifty rupees] for every day during which the breach continues after receipt of notice from the competent authority to discontinue such breach.] [(1A)] Whoever contravenes any of the provisions of Sections 6A[5D, 5E, 5F], 8, 9 to 11, 13, [13A,], 18, 21, 6A[21A], 6B[21B] and 22 shall on conviction be punishable with fine, which for a first offence, may extend to 5A[one lakh rupees] and for a second or any subsequent offence, may extend to 7A[two lakh rupees]. 7B[Provided that the amount of fine for contravention of any of the provisions shall not exceed two thousand and five hundred rupees per employee employed.] 7C[(2) Whoever contravenes any of the provision of Sections 7, 19, 20, 28 and 30 shall, on conviction, be punishable with fine which may extend to fifty thousand rupees: Provided that the amount of fine for contravention of any of the provisions shall not exceed two thousand rupees per employee employed.] 7B[(2A) Whoever, wilfully obstructs an Inspector in exercising all or any of the powers conferred upon him by or under this Act or the rules made thereunder or refuses or wilfully neglects to afford the Inspector any reasonable facility for making any inspection, examination, enquiry or investigation authorised by or under this Act or the rules made thereunder, in relation to a shop or establishment shall be punishable with fine which may extend to one lakh rupees.] (3) No Court shall take cognizance of any offence punishable under this Act or any rule or order made thereunder unless the complaint is made,- (a) by the employee of an establishment either by himself or through the union of which he is a member within three months from the date on which the offence is alleged to have been committed; or (b) by the Inspector within six months from the date on which the alleged offence comes to his knowledge. (4) No Court inferior to that of a 7D[Magistrate of the First class] shall try any offence punishable under this Act or any rules or orders made thereunder. 7B[(5) Notwithstanding anything contained in sub-section (2) of Section 29 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) a Judicial Magistrate of the First Class shall be empowered to impose a fine which may extend to two lakh rupees for the offences punishable under this Act.] Inserted after renumbering existing sub-section (1) as (1A) by Act 32 of 1969, published in K.G.Ext.
