Enhanced punishment for second or subsequent offences.- Whoever, having been convicted by a court, of an offence punishable under this Act again commits the same offence shall be punished for every such subsequent offence with imprisonment for a term which may extend to one year, but which shall not be less than three months, and with fine, which may extend to four thousand rupees: Provided that the court may; for adequate and special reason to be recorded in the judgment, impose a sentence of imprisonment for a term of less than three months.
