(1) Any prisoner who fails to surrender himself, as required by sub-section (1) of section 74, shall be liable to be punished with imprisonment of either description for a term which may extend to two years or with fine or with both. (2) The imprisonment under sub-section (1) shall be in addition to the punishment awarded to the prisoner for the offence or offences for which he is undergoing the sentence. (3) While imposing penalty under sub-section (1), the court shall take into account any mitigating circumstances beyond the control of the prisoner.
