Section 226

[Control of Chairperson over Health Officer.

(1) Notwithstanding anything contained in Travancore-Cochin Public Health Act, 1955 (XIV of 1955) or Madras Public Health Act, l939 (Madras Act III of 1939) the functions vested in the Secretary under this Act relating to public health matters and which are conferred upon the Health Officer by Section 14 of the Travancore-Cochin Public Health Act, 1955 (XIV of 1955), or Section 16 of the Madras Public Health Act, 1939 (Madras Act III of 1939), except the functions involving expenditure from the Municipal fund, shall be exercised by the health officer subject to the control and supervision of the Chairperson. (2) Where there is no Health Officer in any Municipality the Senior Medical Officer of hospital, or public health centres or dispensaries under the control of that Municipality, shall be the health officer ex-officio of the Municipality]. Section 226 substituted by Act 14 of 1999, w.e.f. 24-3-1999. Prior to the substitution section 226 read as under: "226. Power of Secretary over Health Officer.- (1) Notwithstanding anything contained in the Travancore-Cochin Public Health Act,1955 or the Madras Public Health Act,1939, the functions of the Secretary under this Act relating to public health matters which are conferred upon the Health Officer by section 14 of the Travancore-Cochin Public Health Act,1955 (XVI of 1955) or section 16 of the Madras Public Health Act, 1939, (Madras Act III of 1939) except the functions involving disciplinary controls over the employees of the Municipality which are vested in the Secretary under sub-section (3) and the functions of the Health Officer under the said Public Health Acts so far as those functions involve expenditure from the municipal fund or administrative control over the employees of the Municipality, shall be exercised by the Health Officer subject to the control and supervision of the Secretary under this Act: Provided that in Municipalities where there are no Health Officers, the health supervisors and in the absence of both, the first grade health inspectors, shall exercise the functions of the Health Officer. (2) Notwithstanding anything contained in this Act or the Travancore-Cochin Public Health Act,1955 (XVI of 1955) or the Madras Public Health Act,1939 (Madras Act III of 1939), the power of control over the Health Officer shall vest in the Secretary: Provided that nothing contained in this sub-section shall be deemed to empower the Secretary to dismiss or remove the Health Officer from service. (3) Notwithstanding anything contained in the Travancore-Cochin Public Health Act,1955 (XVI of 1955), or the Madras Public Health Act,1939 (Madras Act III of 1939), the functions of the Health Officer under the said Public Health Acts, so far as those functions involve disciplinary control over the employees of a Municipality be exercised only by the Secretary."
