PRECAUTIONS IN CASE OF DANGEROUS TANKS, WELLS, HOLES ETC.— (1) Where any tank, pond, well, hole, stream, dam, bank or other place 'appears to the Secretary to be, fpr want of sufficient repair, protection or enclosure, dangerous to the passer-by or to persons living in the neighbourhood, the Secretary may by notice, require the owner to fill in, remove, repair, protect or enclose the same so as to prevent any danger therefrom. (2) Where immediate action is necessary, the Secretary shall, before giving such notice or before the period of notice expires, cause to take such temporary measures as he deems fit to prevent danger, and the cost thereof shall be recoverable from the owner in the manner provided in section 538.
