(1) Any person who does any of the acts mentioned in sub-section (1) of Section 108 or in clauses (a) to (d) of sub-section (1) of Section 5 of the Madras Prevention of Adulteration Act, [39A] through others employed by him, whether the latter be adults or children, shall be liable to punishment for such act as if he had himself done the same. (2) If a child under seven years of age does any of the acts aforesaid, the employer of the child or the parent or other person having the care and custody of the child, as the case may be, shall be liable to punishment for such act as if he had himself done the same. Repealed by the Prevention of Food Adulteration Act, 1954 (Central Act 37 of 1954).
