(1) On the coming into force of this Act, such members of the Board including the President and such of its subordinates as the [State Government] may consider suitable, may be appointed by the [State Government] in their discretion to any offices provided for in this Act to which they may be deemed qualified; and the services of the rest shall be deemed to have been terminated. (2) The conditions of service of persons so appointed shall be regulated by rules made by the [State Government] from time to time as if they had entered the service of the [State Government] on the date of their first entertainment as a member of the Board or as its subordinate, as the case may be. (3) To those not so appointed, the [State Government] may accord such relief by way of pension, gratuity, provident fund or leave with allowances as they may in their discretion deem fit. (4) No Court shall entertain any suit or application for damages or compensation by any member of the Board or any of its subordinates affected by sub-section (1) or for the variation of the relief, if any, granted under sub-section (3).
