Procedure for Inquiry by Licensing Authority.—(1) If any person contravenes any of the provisions of this Act or the rules or regulations made thereunder, the Licensing Authority shall, after affording the person a reasonable opportunity of being heard shall conduct an inquiry and if, on such inquiry, he is satisfied that the person has violated the provisions of this Act or the rules or the regulations made thereunder shall impose such penalty provided in section 20, by an order as he may deem appropriate. (2) While conducting an inquiry regarding a contravention under sub-section (1), the Licensing Authority shall have the same powers of a Civil Court under the Code of Civil Procedure, 1908 (Central Act 5 of 1908) while trying a civil case in the following matters, namely:— (a) summoning and enforcing the attendance of any witness and examining him on oath; (b) requiring the discovery and production of any document; and (c) receiving evidence on affidavit.
