(1) Notwithstanding anything contained in any law or contract, or in any judgement, decree or order of court, a tenant entitled to fixity of tenure shall have the right to use his holding in any manner he thinks fit: Provided that nothing contained in this section shall be deemed to empower the tenant to use the holding in contravention of any order issued under the Essential Commodities Act, 1955. (2) Notwithstanding anything contained in any law or contract, or in any judgement, decree or order of court, where the tenant in respect of a nilam is a varamdar and the fishing right in that nilam is exercised by the landlord, such right of the landlord shall cease to exist and the tenant shall be entitled to exercise such right].
