Section 47

Procedure on application under section 46.--

(1) When an application and deposit have been made under section 46, the Land Tribunal shall cause written notice thereof to be given at the cost of the applicant to every person who, in the opinion of the Land Tribunal is entitled to be heard thereon and after hearing such of them as appear, by order determine- (a) the amount of arrears due from the tenant for the period specified in the application under sub-section (1) of section 46 together with interest upto the date of deposit and costs, if any; and (b) the person or persons who is or are entitled or bound to receive such amount. (2) If the amount deposited by the tenant under sub-section (2) of section 46 is less than the amount referred to in clause (a) of sub-section (1), the tenant shall deposit the balance amount due within such time as may be directed by the Land Tribunal. (3) If the tenant fails to deposit any amount under sub-section (2) within the time allowed by the Land Tribunal in that behalf, the application shall be dismissed. (4) The Land Tribunal may also make such directions regarding costs, if any, awarded to the applicant and such other matters as the Land Tribunal may deem fit. (5) The deposit of arrears of rent and interest and costs, if any, in accordance with the provisions of this section and section 46 shall be a full discharge of the liability of the tenant for the rent due by him for the period specified in the application. (6) Nothing in sub-section (5) shall affect the right of any person to recover the amount deposited by the tenant towards arrears of rent and interest from the person to whom it is paid by the Land Tribunal].
