(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), no court shall take cognizance of any offence against this Act except on a complaint in writing made by the Government or any officer authorised in that behalf by the Government. (2) Notwithstanding anything contained in section 29 on the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), it shall be lawful for any Magistrate of the First Class specially empowered by the Government in this behalf, to impose a sentence of fine exceeding five thousand rupees when awarding punishment under section 14.
