(1) When a complaint is made before a Magistrate against the driver of hackney carriage under this Act, the Magistrate may if the driver fails to appear, summon the owner to appear and to furnish the correct address of the driver. (2) If the owner after being duly summoned fails, without reasonable excuse, to appear or furnish the correct address of the driver according to the summons, he shall be liable to a fine not exceeding fifty rupees. (3) If the owner fails without reasonable excuse to appear or furnish the correct address of the driver on a subsequent summons requiring him to do so, the Magistrate may dispose of the complaint in the absence of the owner and driver or either of them.
