(1) In the event of any damage caused to any equipment of the licensee within the premises of the consumer, by reason of any act, neglect or default of the consumer or his employee or any person acting on his behalf, the residual cost thereof as claimed by the licensee, based on the guidelines approved by the Commission, shall be paid by the consumer: Provided that the licensee shall submit proposal on the methodology for calculation of the residual cost to the Commission for its approval. (2) If the consumer fails to pay the residual cost as demanded by the licensee, it shall be treated as a contravention of the terms and conditions of supply agreement and the electricity supply is liable to be disconnected: Provided that the tampering or damage or destruction caused to the meter and associated equipment with dishonest intention will attract the provisions of Section 135 of the Act, and such cases shall be separately dealt with in accordance with the relevant provisions in Part XIV of the Act.
