Enhanced punishment for the second or subsequent offence.—Whoever having been convicted by a Court for an offence punishable under this Act, again commits the same offence, shall be punishable for every such subsequent offences with imprisonment for a term which shall not be less than three months or with a fine which may extend to thousand rupees: Provided that the Court may for any adequate and special reasons to be recorded in the judgment, imposes a sentence of imprisonment for a term less than three months.
