Section 81

Tribunal.--

(1) The Government shall constitute a single member Tribunal to exercise the powers and discharge the functions conferred on the Tribunal under this Act. (2) A person shall not be qualified for appointment as a member of the tribunal unless he is or has been holding the post of a District Judge in the State. (3) The term, salary and allowance and other conditions of service of the member shall be such as may be decided by Government from time to time. (4) The Government shall make rules for regulating the procedure and disposal of the business of the Tribunal. Substituted by Act 38 of 1971 for " 81. Tribunal:- (1) The Government shall constitute a Tribunal consisting of three member to exercise the powers and discharge the functions conferred on the Tribunal under this Act. Provided that until a Tribunal is constituted under this sub-section, the powers and functions conferred on the Tribunal under this Act shall be exercised and discharged by the Government. (2) A member of the Tribunal shall be a person who have been in practice as an Advocate for at least ten years. (3) The Government shall appoint one of the members of the Tribunal to be its chairman. (4) The term, salary and allowances and other conditions of service of the chairman and other members of the Tribunal shall be such as may be prescribed. (5) Any vacancy in the office of the a member of the Tribunal shall be filled by the Government. (6) The functions of the Tribunal may be performed:- (a) by a Bench consisting of two members of the Tribunal; or (b) by a Bench consisting of two members constituted by the Chairman; or (c) by a Bench consisting of the Chairman and the other member in the event of the office of a member other than the Chairman being vacant. (7) Where an appeal for application is heard by a Bench consisting of all the three members of the Tribunal and the members differ in opinion on any point, the point shall be decided in accordance with the opinion of the majority. (8) Where an appeal or application is heard by a Bench consisting of two members and the members are divided in their opinion on any point, the point shall be referred for decision to the Bench consisting of all the members. (9) The Government shall make rules for regulating the procedure and the disposal of the business of the Tribunal".
