(1) Any member nominated under clause (c) or clause (d) of sub-section (3) of Section 4 may resign his office by giving three months' notice in writing to the Government or the Bar Council, as the case may be, and on such resignation being accepted by the Government or the Bar Council shall be deemed to have vacated his office: Provided that the Bar Council shall consult the Government before accepting the resignation. (2) A casual vacancy in the office of a member referred to in sub-section (1) may be filled up, as soon as may be, by the Government or the Bar Council, as the case may be, and a member so nominated to fill such vacancy shall hold office for the unexpired portion of the term of office of the member whose place he fills.
