Relinquishment of area reserved for road.– In case of khatadar or person responsible, request for sanction of building plan before the road widening is taken up by the City Corporation or any other Authority:- (i) The khatadar of building site shall relinquish the area required or reserved for road formation or widening in the master plan or as notified by the City Corporation free from all encumbrances, before the sanction is accorded for the building plans under this act. (ii) Two times the area surrendered for formation of road or widening of existing road may be allowed to avail the FAR area on the remaining building site, in lieu of compensation for the relinquished portion of plot. (iii)The area of building site relinquished to the City Corporation as per sub- section (1) will not be entitled for any type of compensation including development rights under section 14B of the Karnataka Town and Country Planning Act, 1961 (Karnataka Act 11 of 1963). (iv) Wherever, the ordinarily permissible floor area ratio cannot be achieved in case of land surrendered for road formation or widening under this section the Commissioner may consider relaxing setbacks and coverage to a maximum extent of twenty five percent and as may be notified by the Government.
