Penalty for contravention of bye-laws.- whoever contravenes a bye-law made under section 116 shall , on conviction, be punished with imprisonment for a term , which may extend to six months or with fine which may extend to one thousand rupees or with both. 83 A. in addition to and without prejudice to the right available to the Board under the provisions of this Act or any other law or rules in force the Board shall be entitled to be following by way damages.-(1) Any person who without any right or written permission of the Board continues in possession of a building belonging to the Board after termination of his tenancy in respect to it shall be liable to pay damages equal to three time of rent payable immediately before the termination of the tenancy. (2) Any person who without any right or written permission of the Board continues in possession of any land of the Board after termination of his tenancy in respect of it, shall be liable to pay damages at the rate of rupees twenty per hundred square metre of the area of land per day until delivery of possession of the vacant land to the Board. (3) Any person who takes possession of any land or building of the Board without any right or written permission of the Board and/or continues with such possession shall be liable to pay damages at the rate of rupees twenty per day for each one hundred square metre of land area, in case of land and at 4545 | P a g e the rate of rupees fifty per day for each hundred square metres of build up area of each floor of the building, in case of building. (4) Where the tenant sublets the building or any part thereof belonging to the Board in contravention of the terms of tenancy his tenancy shall stand terminated with effect from the date of subletting and both the tenant and sub-tenant shall be liable to pay damages jointly and severally to the Board at a rate equal to three times the rate of rent payable for building immediately before the termination.
