Enhanced punishment after previous conviction If any person, after having previously been convicted of any offence punishable under Sec. 47, Sec 49, Sec. 55 or Sec. 56 or under similar provisions in the Bengal Excise Act, 1909 (5 of 1909), or in any previous enactment repealed thereby, subsequently commits and is convicted of an offence punishable under any of those Sections, he shall be liable to twice the punishment which might be imposed on a first conviction under this Act. Provided that nothing in this Section shall prevent any offence which might otherwise have been tried summarily under Chapter XXI of the Code of Criminal Procedure, 1973 (2 of 1974) from being so tired.
