Section 182

Constitution of Special Courts.

(1) The Government in consultation with the High Court may, for the purposes of providing speedy trial of offences referred to in section 156 and sections 159 to 171, by notification constitute as many Special Courts as may be necessary for such area or areas, as may be specified in the notification. (2) Where the office of the judge of a Special Court is vacant, or such judge is absent from the ordinary place of sitting of such Special Court, or where no Special Court has been constituted under the Act, the functions of the Special Court shall be disposed off by the Chief Judicial Magistrate having jurisdiction in the area. (3) Notwithstanding anything contained in the Code of Criminal Procedure, Samvat 1989, every offence punishable under section 156 and sections 159 to 171 shall be triable by the Special Court or the Chief Judicial magistrate, as the case may be, within whose jurisdiction such offence has been committed.
