While 1 [holding any inquiry] under this Act, the Custodian shall have the same powers as are vested in a Court under the 2 [Code of Civil Procedure, 1908 (5 of 1908), when trying a suit in respect of the following matters, namely :— (a) enforcing the attendance of any person and examining him on oath ; (b) compelling the discovery and production of documents ; (c) any prescribed matter ; and the inquiry by the Custodian shall be deemed to be a judicial proceeding within the meaning of sections 193 and 228 of the 3 [Indian Penal Code (45 of 1860)], and the Custodian shall be deemed to be a Court within the meaning of 4 [sections 345 and 346 of the Code of Criminal Procedure, 1973 (2 of 1974)].
