Upon receiving a direction under section 3, the District Magistrate shall publish a notice in the prescribed manner calling upon habitual offenders–– (i) to appear at a time and place specified therein before the person appointed by him in this behalf, (ii) to give to that person such information as may be necessary to enable him to complete the register, and cause a register of habitual offenders to be prepared : Provided that before entering the name of any person in such register the District Magistrate or a Magistrate not below the rank of second class (Magistrate) appointed by him in this behalf shall give him a reasonable opportunity to show cause why such entry should not be made.
