Where land is held by a person–– (a) under sub-section (2) of section 6 of the Jammu and Kashmir Big Landed Estates Abolition Act, Samvat 2007 ; or (b) in personal cultivation as owner or as tenant or allottee directly under the 1 [Union territory of Jammu and Kashmir] whose rights, title and interest therein have been extinguished by section 5 ; such person shall be liable, in respect of such land from the date of commencement of this Act until the entry into possession of the allottee of such land in pursuance of its disposal under this Act, to payment of rent to the Government at the rate of forty times the sum of the land revenue assessed on, and cesses and other charges and dues payable for, such land under any law for the time being in force.
