(1) Any person who commits any act prohibited under section 3 or fails to perform their duties assigned under section 5 of this Act shall be punished with imprisonment of either description for a term which may extend to two years or fine, or with both. (2) No court shall take cognizance of an offence punishable under sub-section(1) against any person, unless a complaint in writing is made by public servant authorised by the Government, by notifications, in the Official Gazette .
