Punishment for sale of tobacco products without a valid registration.- (1) Any person who contravenes the provisions of section 4 shall be guilty of an offence under this Act and shall, on conviction, be punished with imprisonment for a term which may extend to three months or with fine which may extend to fifty thousand rupees or with both, and for the second or subsequent contravention, with imprisonment which may extend to one year and with fine which may extend to one lac rupees. (2) Save as provided under sub-section (1), any material or other tobacco products in respect of which any provision of this Act has been or is being contravened, shall be liable to confiscation.
