Defect or irregularity not to vitiate proceedings.- (1) Notwithstanding anything contained in this Act, but subject to any general or special order of the Government, where two-thirds of the total members of a Panchayat have been elected, the Panchayat shall be deemed to have been duly constituted under this Act. (2) No act done or proceeding taken by a Panchayat or Standing Committee or any other Committee appointed under this Act shall be questioned on account of any vacancy in membership or any defect in the election or qualification of the Chairman, Vice-Chairman, presiding authority, or member or any defect or irregularity of such act or proceeding or its procedure not affecting the merits of the case. (3) Until the contrary is proved, every meeting of Panchayat or Standing Committee or any other Committee shall be deemed to have been duly convened and held and all members, attending the meeting, shall be deemed to have been duly qualified when the minutes of the meeting have been duly signed in accordance with the provisions of this Act or the rules made thereunder.
