Oath or affirmation of allegiance.- (1) Notwithstanding anything contained in the Oaths Act, 1969 (44 of 1969) no elected office bearer of a Panchayat shall enter upon his office, until he has, in the manner prescribed, taken oath or made affirmation of his allegiance in the form specified in Schedule-V. (2) If any such person refuses to take or make such oath or affirmation, except on account of such disability for which permission of the prescribed authority is obtained, his election shall be deemed to be invalid and a fresh election shall take place. (3) No person whose election has been deemed to be invalid under this section shall be eligible for election as the member, Pradhan or Up- Pradhan of Gram Panchayat or the member, Chairman or Vice-Chairman of Panchayat Samiti or Zila Parishad, as the case may be, for a period of two years from the date on which he ought to have taken or made such oath or affirmation.
