Establishment of the Authority.- (1) With effect from such date as the State Government may, by notification appoint in this behalf, establish for carrying out the purposes of this Act, an Authority to be known as the Himachal Pradesh Housing and Urban Development Authority with the headquarter at such place as the State Government may specify. (2)The Authority shall by the name aforesaid, be a body corporate having perpetual succession and a common seal, and, subject to any restriction by or under this Act or the rules made there under, shall have the powers to acquire, hold, administer and transfer property movable or immovable, and to enter into contracts, and shall by the said name sue and be sued and do all such things as are necessary for which it is constituted. THE HIMACHAL PRADESH HOUSING AND URBAN DEVELOPMENT 7 AUTHORITY ACT, 2004 (3) For the purposes of this Act and the Land Acquisition Act, 1894,( 1 of 1894) the Authority shall be deemed to be a Corporation.
