Court competent to try offence and cognizance of offences.- (1) No court other than the court of a Magistrate of the First Class shall take cognizance of, or try, an offence under this Act. (2) No court shall take cognizance of any offence under section 9 of this Act except on a complaint in writing of an officer empowered by the 1[Government of Himachal Pradesh] in this behalf. (3) A police officer may arrest without warrant any person who commits an offence punishable under sections 27 and 28 of this Act.
