The following procedure shall be followed while awarding punishment by the Superintendent to the prisoners who commit a prison offence, namely:- (a) the Superintendent shall not award any punishment to any prisoner for any cognizable offence in which a case has been registered. However, necessary preventive action may be taken by the Superintendent to ensure peace, tranquility and to maintain law and order in prison. If necessary, the Superintendent may take assistance from District Magistrate and Superintendent of Police in this regard. NOTE.- Care should be taken by the Superintendent to ensure that there is no double jeopardy in any case. (b) prisoner who has committed any major prison offence but criminal case has not been registered for that offence, then he shall be produced before the Superintendent by the Deputy Superintendent (Administration) along with his history ticket, witnesses and other relevant records in which the offence committed is recorded; (c) contents of such major prison offence shall be read over to the concerned prisoner and a copy of the entry of such information shall be given free of cost to the prisoner; HARYANA GOVT. (EXTRA.), DEC. 30, 2022 (PAUS. 9, 1944 SAKA) 1235 (d) the Superintendent shall record the statements of witnesses in the presence of the concerned delinquent prisoner and give him a copy of statements of witnesses before proposing any punishment for major prison offence committed by the prisoner; (e) the punishment so proposed by the Superintendent shall be forwarded by the Superintendent to the District and Sessions Judge concerned within twenty-four hours with all the relevant record for judicial appraisal of the proposed punishment; (f) the District and Sessions Judge may hear the prisoner personally and may approve/disapprove the proposed punishment after due consideration; (g) the proposed punishment shall come into effect only after the receipt of the judicial appraisal by the respective District and Session Judge. NOTE.- For minor and very petty matters, where the punishment like warning etc, is imposed the same shall be imposed by the Superintendent and there is no need to follow the above said procedure.
