(1) Prisoners in semi-open air prison or open air prison shall earn their livelihood by undertaking one or more work of the nature specified below, namely :- (a) agriculture; (b) dairy farming; (c) manufacturing activities or industrial task; (d) information technology or service sector; (e) construction or repair work etc; (f) outside canteen management or shops opened by the prisons department; (g) any other work, as permitted by the Superintendent or Director General, from time to time. 1422 HARYANA GOVT. (EXTRA.), DEC. 30, 2022 (PAUS. 9, 1944 SAKA) (2) The working hours for a prisoner shall ordinarily be between the lockout and lockup timings of the regular prison: Provided that the Director General may allow any prisoner to work beyond these hours for reasons to be recorded in writing. (3) If a prisoner has no work to perform in semi-open air prison or open air prison, he may be allowed to work outside within a radius of 10 kms in case of semi-open air prison and 20 kms in case of open air prison by the Superintendent: Provided that such prisoner shall give complete details about the place of work and particulars of the employer etc. to the Officer-incharge. (4) The prison authorities may at any time visit the place of work, in case the prisoner is not found at the place of work, he shall be transferred to the regular prison and shall be proceeded against as if he has committed a major prison offence. (5) The Superintendent shall help the prisoner shifted to the semi-open air prison or open air prison in processing his work and ensure that the prisoner is being paid such minimum wages by his employer, as fixed by the Government, from time to time. (6) If a prisoner shifted to open air prison is employed by the Superintendent to perform any work, he shall be paid such minimum wages, as fixed by the Government, from time to time. (7) The Government organizations and registered Non-Governmental Organizations shall be encouraged to provide work to a prisoner shifted to semi-open air prison or open air prison. (8) A prisoner whose conduct in the opinion of the Officer-incharge is unsatisfactory or who fails to earn his livelihood or who for any other reason is found unfit for stay in semi-open air prison or open air prison, a detail report of such prisoner shall be forwarded to the Superintendent, who alongwith his recommendation send a report to the Director General for transfer of such prisoner back to regular prison. NOTE.- The Director General may permit the prisoners of semi-open air prison or open air prison to participate in marketing the prison products in the fair etc. under proper escort.
