(1) Convicts who have been appointed as convict officers shall be deemed to be public servants within the meaning of the Indian Penal Code, 1860 (Central Act 45 of 1860). (2) All appointments to the position of convict officers shall be made by the Superintendent: Provided that no convict, who does not possess the necessary qualifications, shall at any time be so appointed without the previous sanction of the Director General. (3) A convict who is physically and mentally fit to perform duties of convict officer shall be eligible to be appointed as convict officer provided he possess the following further qualifications, namely: - (a) he is not a habitual prisoner; (b) his substantive sentence of imprisonment is not less than twelve months; (c) he has completed one-fourth of his substantive sentence if sentenced to term imprisonment and five years in case sentenced to life imprisonment; (d) he is well behaved and an industrious prisoner; and (e) he is not punished for any major punishment in the last two years.
