Every prisoner under sentence of death shall be treated in the following manner, namely :- (a) when any person is sentenced to death by a Court of Sessions, in terms of section 366 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), the sentence shall not be executed unless it is confirmed by the High Court; (b) when the sentence has been confirmed by the High Court or is passed by the High Court in appeal or revision, the Court of Sessions shall issue a warrant to the Superintendent to cause the sentence to be carried into effect. The Superintendent shall not cause the sentence to be executed unless the Court of Sessions has issued the requisite warrant to that effect; (c) if the condemned prisoner has been transferred to another prison, the Superintendent to whom the original warrant of commitment was addressed, shall return the warrant to the Sessions Judge, informinghim at the same time the particulars of the prison to which the prisoner has been transferred; (d) the Sessions Judge shall issue a revised warrant for the execution of sentence of death to the Superintendent concerned; (e) all executions shall take place at the prison to which the warrant is directed unless expressly ordered otherwise in the warrant. They shall usually be carried out in a special enclosure attached to, or within the walls of the prison. No convict shall be executed on a day that has been notified as a public holiday.
