The expression prisoner with mental illness shall be deemed to include persons of the following classes, namely :- (a) persons being dealt with by the Court or Magistrate under sections 328, 329, 330 or 335 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974) and ordered to be detained thereunder; and (b) prisoner who becomes mentally ill after his admission into the prison.
